A Maryland court ruling has given Intralot another opportunity to challenge its disqualification from the 2025 bidding process to manage the state lottery system.
The Greek lottery tech firm was initially selected as the preferred bidder with its $260m proposal for the 10-year contract by the Maryland State Lottery and Gaming Control Commission (MLGCC).
However, following a challenge by runner-up Scientific Games in July 2025, Intralot’s bid was subsequently rejected by the Commission on 1 August, with officials deeming it non-responsive over alleged deficiencies in its minority business enterprise (MBE) requirements.
At the time, Intralot stated: “This decision comes as a great surprise, especially considering that Intralot, Inc. had allocated a significantly higher percentage of the project to local subcontractors than the minimum required.
“Moreover, the company had provided the Commission with very detailed clarifications, and the Commission was fully aware of the identity and role of these subcontractors.”
The rejection was subsequently upheld by the Maryland State Board of Contract Appeals (MSBCA), which dismissed Intralot’s relevant appeals after finding that its MBE participation schedule was deficient under the applicable procurement rules and that the deficiency could not be corrected retrospectively.
Intralot then challenged the MSBCA’s decision before the Maryland Circuit Court, where Judge Paul J. Cucuzzella later ruled that the Board had misinterpreted the law.
Under the court’s interpretation of Maryland’s Procurement Reform Act of 2025, the Procurement Officer should have notified Intralot of the deficiency and directed the company to submit an amended MBE participation schedule.
The court therefore reversed the Board’s decision and referred the matter for further proceedings.
Although the ruling does not determine who will manage Maryland’s lottery over the next 10 years, it gives Intralot another opportunity to legally challenge its disqualification from the original bidding process.
